University of Idaho Professor Emeritus Don Burnett will talk about “The Independent State Legislature — Fringe Political Theory or Constitutional Mandate?” at noon Wednesday, Sept. 28, at the 1912 Center’s Lecompte Auditorium as part of the Moscow League of Women Voters fall speaker series.
Burnett, a past dean of the UI College of Law, will address questions about the so-called “independent state legislature” theory, including whether a state legislature could appoint the state’s Electoral College delegates independently from the popular vote in that state.
The U.S. Supreme Court is set to hear a case from North Carolina this fall testing the constitutional validity of the theory, and Burnett will discuss the controversy and its potential implications.
